Santos v. Ohio Bureau of Workers’ Compensation, Cuyahoga C.P. Case No. 393694
This class action lawsuit produced a judgment ordering the Ohio Bureau of Workers Compensation to return approximately $52,000,000 in subrogation payments that were collected from roughly 8,000 injured workers under the authority of an unconstitutional statute, R.C. §4131.931. The lawsuit was originally filed in Cuyahoga County Court of Common Pleas in October 1999 and took nearly seven years to conclude. Two appeals, including one trip to the Ohio Supreme Court, were necessary.
